NVIDIA GTX 970(and others) class action lawsuit

I recently-ish stumbled upon enough money for a 970, I got an MSI GTX 970 and it's.. well it's running quite worse than my dad's ASUS 970, also it's having serious frame drops (unlike my old 660 which -even with worse performance and general ability- would virtually never do this)

Any ideas? I'd love 30$ but it's not going to buy me a new card, I just decided this would be the best place to ask if you guys knew any way I could optimize this 970 and get it to run well.
