Washington (DC) - The Recording Industry Association of America has filed a landmark federal lawsuit in Arizona, claiming that it is illegal for users to make copies of CD tracks to their computer for personal use.

The RIAA is going after Jeffrey Howell of Scottsdale, AZ. The group alleges that Howell shared 54 music files over the peer-to-peer network Kazaa. This kind of complaint has become commonplace for the RIAA, but they added something different to this lawsuit.

Ira Schwartz, an Arizona-based lawyer for the trade group, says Howell is also guilty of making "unauthorized copies" of CD tracks by ripping them to his computer, even though he may never have shared them with anyone else.

"It is undisputed that Defendant possessed unauthorized copies of Plaintiffs' copyrighted sound recordings on his computer," said Schwartz in a legal brief. "Once Defendant converted Plaintiffs' recording into the compressed .mp3 format and they are in his shared folder, they are no longer the authorized copies distributed by Plaintiffs."

This means that the RIAA is saying it could actually come after anyone who has ever used a CD ripping program to transfer tracks from a disc to a computer, regardless of whether or not file sharing was involved. The organization's website makes this clearer by noting, "If you make unauthorized copies of copyrighted music recordings ... you could be held legally liable for thousands of dollars in damages."

The case against Howell is believed to be the first to take this stance this far into the legal process.

WHAT!? THATS RIDICULOUS! IF I PAYED FOR THE CD, I SHOULD BE ABLE TO PUT IT WHEREVER I WANT AS LONG AS ITS FOR MY OWN USE!

The damn recording industry needs to stop complaining...ok fine file sharing makes sense why it should be illegal but ripping?!?! come on... When I go out
and buy a cd for 20 bucks that cost probably 15 cents to make and i can only listen to it by putting it on my cd player in my car or computer I'm gonna be pissed.


One note: Does that mean that all the mp3-player users in the world are now breaking the law by putting their cds on to their computer and then onto their device??!!?

I read some where (can't remember where atm) that the RIAA said it believes ripping is illegal, but will not go after people who only rip. Personally Id like to see them go bankrupt from trying. :) I don't know anyone who hasn't rip'd a cd, that would be a lot of cases.

I will have to find it again but I found where the Federal Government said it is legal to make a backup copy of any CD/DVD you have purchased so long as you do not share the contents of the CD/DVD. There was no such stipulation of how the backup copy had to be made just that you could make a backup with out penalty of breaking copy right laws.

I believe that there is a federal law already in place that secures your right to backup for nonprofit personal use. Until that it overturned or replaced, I think it's all a bunch of theatrics and scare tactics. They're bullies, and anyone/thing RIAA associated should be boycotted! Lets add the MPAA to the list too.

As is the case in most of these cases it was misreported. Turns out that the issue with this case is that the user was ripping his CDs and then putting the songs on a shared drive. The tech sites that first picked this up and the Washington Post which moved it to the MSM missed that little factoid:

Since putting it on a shared drive is essentially the same as making it available via bit torrent or other shared internet file systems, just on a smaller network than the WWW, I can see the argument as a valid extension of the RIAA's normal crap lawsuits.
